A crackdown on advertising billboards in Qingdao,
Shandong Province, meant to eliminate visual pollution before the 2014 Horticultural
Expo has lead to doubts about government procedure for such events, according
to the Beijing-based financial news website caixin.cn Monday.
The crackdown,
which started in December 2010, aims to remove all billboards that could be considered
unattractive.
However, the local government has not made a standard to define
visual pollution except to announce it would clear up the less eye-pleasing boards
and promote a good visual effect and elegant view of the city.
Despite the fact
most of the advertisements were approved by city authorities, 23 legal advertisement
boards, which make up 30 percent of the total number of boards in the city, were
demolished.
The demolitions finally led to a confrontation on Friday, in which
an employee of an advertisement company suffered a broken nose during a beating.
The the city government is unavailable for comment Monday.
The Haoyue advertisement
company, which is the employer of the beaten man, received a notice from the local
district administrative and law enforcement bureaus on September 5 ordering them
to demolish the board within three days.
The company appealed for an administrative
review of the case on September 20. But, before the review procedure was finished,
their board was already gone.
Several big companies intend to sue the local
governments, but fear they will get the same result as Haoyue, according to caixin.cn.
On
October 10, the local government department issued a document, in which it is
stated there are three ways to deal with users of legal boards which are compensation,
replacement of the boards and cancelling administrative approval for using the
board.
However, all advertisement companies told Caixin they directly received
a letter telling them their permits were cancelled without any forms of negotiation.
"If
the boards had legal approval from government authorities, the companies have
a right to request a hearing, appeal for a review of the cases and even administrative
litigation," Zhu Shouquan, a lawyer with the Beijing Changji Law Firm, told
the Global Times.
"Local government should take opinions from companies
and stakeholders to let them realize the meaning of government action. Otherwise,
in the long run, it compromises the local government's credibility," Zhu
suggested Monday.

“如果广告牌获得了政府机关的合法批准,广告公司有权要求举行听证会、提出复议、甚至行政诉讼,”,北京长济律师事务所律师朱寿全告诉环球时报记者。
“当地政府应听取公司和利益相关者的意见,让他们认识到政府的行动的意义,否则,从长远来看,它损害了当地政府的公信力。”朱律师在星期一建议。
