Woman portrayed seeking 'boy toy' sues media

A 36-year-old Jiangxi Province woman who has discovered herself the online
face of boy-toy seeking ladies is suing the Xinhua News Agency and at least nine
other media outlets for violating her image rights.
Guo Kexin of Nanchang, who works at a home for the elderly in Beijing, said
unpleasant gossip about her circulated among friends and neighbors after her image
was distributed by mostly State-owned media.
In her lawsuit filed at the Beijing Chaoyang People's Court, she demanded 50,000
yuan ($7,344.94) in compensation, a public apology and that all media delete the
offending content immediately.
A website that introduces boy toys to the rich posted a photo of Guo at qianguiz.com
with the claim that a wealthy jade import-export company board chairwoman was
looking for a boy toy. A photo of Guo was attached to an ad with brief personal
information for the alleged chairwoman.
As is common practice on the Chinese mainland, the report was widely copied
and republished online without attribution. The original can be traced to the
Sanxiang City Express, a Hunan Daily Press Group paper.
The case will open next Monday, said Yi Li, a Beijing Chaoyang People's Court
spokeswoman.
Two conditions must be met to prove violation of image rights, said Zhu Shouquan,
director of the Beijing Changji Law Office. The first is that the image was used
to make a profit, and second is that the person portrayed was negatively impacted.
"If qianguiz.com used Guo's photo without her permission, it definitely
violated her image rights," Zhu said.
How much media, editors or online censors were aware of the photo's lack of
authenticity would be a crucial deciding factor in Guo's quest for compensation,
he said." The media should bear some responsibility, as the senior editors
failed to see the possibility that the photo might not be authentic," he
said." But at the end of the day, it's the judge's call."

“如果qianguiz.com使用郭的照片而没有经过她的许可,那么肯定侵犯了她的肖像权” 朱寿全说。
“有多少媒体、编辑或网络审查员意识到了照片不真实,是郭的赔偿要求中的一个重要决定因素。”他说。“媒体应该承担一定的责任,因为资深编辑未能发现照片可能不是真的。”他说,“但是最终要由法官裁决。”
